These Terms of Use ("Terms") govern your use of aetherhan.com and of the apps, games and publications offered by Aetherhan Works LLC ("we", "us"). By using the Website or a Product, you agree to these Terms.
01Use of the Website
You may browse the Website for personal and lawful business purposes. You agree not to interfere with its operation, attempt to gain unauthorised access to it, or use it to distribute malicious code.
02Products and app stores
Products obtained through a third-party platform (such as Apple App Store, Google Play or Huawei AppGallery) are also subject to that platform’s terms. For Products obtained from the Apple App Store, the Apple Licensed Application End User License Agreement applies unless a Product provides its own licence agreement.
A Product may come with additional terms, such as an end-user licence agreement. Where they conflict with these Terms, the Product-specific terms govern for that Product.
03Purchases and refunds
Prices, payment and refunds for purchases made through a platform are handled by that platform under its policies. Nothing in these Terms limits any rights you have under applicable consumer protection law.
04Intellectual property
The Website, the Products and their content — including software, artwork, text, music and trademarks — are owned by or licensed to Aetherhan Works LLC and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Products for personal, non-commercial purposes. You may not copy, modify, distribute, reverse-engineer or resell them except as permitted by law or by us in writing.
05Your content
You keep ownership of content you create with a Product. If you submit feedback or suggestions, you allow us to use them without obligation to you.
06Disclaimers
The Website and Products are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
07Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or revenue. Our total liability for any claim relating to the Website or a Product will not exceed the amount you paid for that Product in the twelve months before the claim, or USD 50, whichever is greater.
08Governing law
These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-law rules. Where you are a consumer, you also benefit from any mandatory provisions of the law of the country in which you live.
09Changes
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use after an update means you accept the revised Terms.
